Zero-Tolerance & Intended-Use Policy

Policy Introduction

Aqua Vera, a brand operated by The Gray Area Lab LLC (“Aqua Vera,” “we,” “us,” or “our”), maintains a strict zero-tolerance policy concerning the misuse of its products.

This policy establishes the only purposes for which Aqua Vera products may be purchased, possessed, transferred, or used.

By accessing our website, creating an account, purchasing a product, or enrolling in a subscription, you acknowledge and agree to this policy.

1. Permitted Intended Use

Aqua Vera products are sold exclusively for lawful, non-clinical laboratory research conducted by adults who are at least 21 years old.

Permitted purposes are limited to legitimate laboratory-based analytical or in vitro research that does not involve administration to a human or animal.

The designation Research Use Only is a mandatory condition of every Aqua Vera sale. It is not a recommendation, suggestion, or optional disclaimer.

2. Prohibited Uses

Aqua Vera products must never be used, purchased, transferred, or promoted for:

• Human or animal consumption;
• Human or animal administration;
• Injection, ingestion, inhalation, or topical application;
• Personal, household, cosmetic, or recreational use;
• Diagnosis of any condition;
• Treatment, prevention, mitigation, or cure of any disease;
• Clinical, therapeutic, pharmaceutical, or veterinary use;
• Compounding or preparing a medication;
• Preparing, diluting, mixing, or reconstituting any substance intended for human or animal administration;
• Use with a syringe, injection device, or administration supplies for a human or animal;
• Use as a drug, drug component, medical product, or therapeutic product;
• Any purpose inconsistent with the product label;
• Any unlawful activity; or
• Any attempt to evade FDA or other regulatory requirements.

Packaging, labeling, purity information, or any other product characteristic does not authorize a prohibited use.

3. Purchaser Certification

By purchasing an Aqua Vera product, you certify and represent that:

• You are at least 21 years old;
• You are purchasing solely for lawful, non-clinical laboratory research;
• The product will not be administered to or used on a human or animal;
• The product will not be used to prepare another substance for human or animal administration;
• You have the knowledge, training, facilities, and procedures necessary to handle research materials appropriately;
• You will comply with the product label and applicable documentation;
• You will comply with all applicable local, state, and federal laws;
• You will not resell, transfer, relabel, or redistribute the product for a prohibited purpose; and
• You will prevent unauthorized individuals from accessing the product.

These certifications apply to one-time purchases, subscription orders, bulk purchases, replacements, and all other orders.

4. No Medical or Administration Guidance

Aqua Vera does not provide:

• Medical advice;
• Veterinary advice;
• Dosage information;
• Injection instructions;
• Administration instructions;
• Human or animal reconstitution instructions;
• Treatment recommendations;
• Medical compatibility information; or
• Guidance concerning personal use.

Aqua Vera customer-service representatives will not answer questions concerning prohibited uses.

Requests involving dosage, injection, administration, personal treatment, or preparation of a substance for human or animal use may result in:

• Termination of the conversation;
• Cancellation of an unshipped order;
• Suspension of an active subscription;
• Closure of the customer account; or
• Refusal of future service.

Do not submit medical records, health information, photographs of medical conditions, or other unnecessary sensitive information through our website or Contact Us form.

5. No Human or Animal Product Claims

Aqua Vera does not represent that its products:

• Diagnose, treat, prevent, mitigate, or cure any condition;
• Affect the structure or function of a human or animal body;
• Are safe or effective for human or animal administration;
• Are prescription or over-the-counter medications;
• Are approved, cleared, or authorized by the FDA for human or animal use; or
• Are substitutes for products obtained through a licensed medical or veterinary provider.

Website content must not be interpreted as making any such representation.

6. Product Handling and Responsibility

Customers are responsible for:

• Inspecting products promptly upon delivery;
• Following the product label and available documentation;
• Maintaining appropriate laboratory conditions;
• Preventing unauthorized access;
• Following appropriate storage and handling procedures;
• Using appropriate laboratory safety practices; and
• Disposing of products in accordance with applicable requirements.

The customer is responsible for determining whether a product is suitable for a particular lawful research protocol based on the specifications expressly provided by Aqua Vera.

Aqua Vera does not authorize any use outside those specifications or this policy.

7. Resale, Transfer, and Redistribution

Purchasing multiple units or receiving bulk pricing does not automatically authorize resale or distribution.

Unless Aqua Vera provides prior written authorization, customers may not:

• Resell or redistribute Aqua Vera products;
• Relabel or repackage the products;
• Remove or conceal warnings;
• Market the products under another brand;
• Represent themselves as an Aqua Vera distributor;
• Transfer the products to an individual or organization intending a prohibited use; or
• Advertise the products for human, animal, medical, clinical, therapeutic, or pharmaceutical use.

Authorized resellers or commercial customers remain responsible for ensuring that every downstream recipient follows this policy.

8. Order Review

Aqua Vera may review an order or customer communication when necessary to verify compliance with this policy.

We may request additional information concerning:

• Age or identity;
• The nature of the proposed research;
• The purchasing organization;
• Requested quantities;
• An unusual ordering pattern; or
• Statements suggesting a prohibited intended use.

Providing false or misleading information is a material violation of this policy.

Aqua Vera is not obligated to approve an order merely because payment was authorized or an automated confirmation was issued.

9. Enforcement

Aqua Vera may take one or more of the following actions when we reasonably believe this policy has been or may be violated:

• Refuse an order;
• Cancel an unshipped order;
• Limit purchase quantities;
• Suspend or cancel a subscription;
• Restrict or close a customer account;
• Block associated future transactions;
• Decline to provide prohibited-use assistance;
• Revoke reseller or wholesale authorization;
• Preserve relevant records;
• Report an immediate safety threat; or
• Cooperate with a lawful regulatory, court, or law-enforcement request.

If Aqua Vera cancels an order before any merchandise ships, amounts collected for the unshipped merchandise will be refunded.

Canceling an account or subscription does not automatically refund a previously processed or shipped order. Shipped orders remain governed by our Returns & Refunds Policy and applicable law.

Aqua Vera will apply this policy without unlawful discrimination.

10. Reporting Suspected Misuse

Customers, researchers, employees, and members of the public may report suspected product misuse through the Aqua Vera Contact Us form.

Please include:

• The nature of the concern;
• The product involved;
• Relevant order information, if available; and
• Supporting details that can be provided lawfully.

Do not place yourself or another person at risk when gathering information.

If you believe someone is experiencing a medical emergency, contact emergency services immediately. Aqua Vera does not provide emergency or medical assistance.

11. Conflicting Statements

No customer, reviewer, affiliate, reseller, influencer, or other third party is authorized to promote Aqua Vera products for a use prohibited by this policy.

If you encounter content that appears inconsistent with this policy, report it through our Contact Us form.

A disclaimer does not override contradictory marketing or conduct. Aqua Vera intends for its product pages, advertising, customer communications, partnerships, and order practices to remain consistent with the intended use stated here.

12. No Regulatory Authorization

This policy does not:

• Grant permission to conduct regulated activity;
• Replace required laboratory procedures;
• Exempt a customer from any law;
• Establish that every possible research use is lawful;
• Replace advice from a qualified legal or regulatory professional; or
• Transfer Aqua Vera’s own legal responsibilities to the customer.

Customers remain responsible for determining and complying with the requirements applicable to their activities.

13. Relationship to Other Policies

This policy is incorporated into and forms part of the Aqua Vera Terms of Service.

If another store policy appears to authorize conduct prohibited here, this Zero-Tolerance & Intended-Use Policy controls concerning permitted product use.

14. Policy Updates

Aqua Vera may update this policy to reflect changes in products, business practices, legal obligations, or regulatory guidance.

Changes will be posted with a revised “Last updated” date. Continued use of the website or purchase of products after an updated policy becomes effective constitutes acceptance to the extent permitted by law.
